From the turn of the 19-century to the early 1980’s, asbestos was
processed into thousands of commercially used products. Many of these
products were widely used during the construction of residential, commercial
and industrial buildings. More than likely, any building constructed or
renovated between the turn of the century and the early 1980’s will
have asbestos-containing material (ACM) within the building components.
As asbestos is a hazardous material and a known carcinogen, it is one
of twelve (12) Designated Substances regulated under the Occupational
Health and Safety Act, R.S.O. 1990, c. 0.1 (OHSA), in the Province of
Ontario. The control of asbestos and ACM is outlined within the following
two OHSA Regulations:
Regulation 837 R.R.O. 1990, outlines the obligations of employers and
employees in an occupational setting where asbestos is used, produced
or stored.
Regulation 278/05, outlines the obligations of owners, employers and
employees on construction projects and in buildings and repair operations
where ACM are affected. This Regulation also classifies work procedures
(Type 1, Type 2 and Type 3) when ACM requires removal and prescribes corresponding
safety precautions. This regulation came into effect November 01, 2005
and revokes the previous asbestos regulation (838 RRO 1990).
