What is a Record of Site Condition (RSC)?

An RSC is a legally recognized document submitted to the Ministry of the Environment, Conservation and Parks (MECP). It summarizes the results of Environmental Site Assessments (ESAs), risk assessments, and any necessary remediation work to confirm that a property meets the applicable environmental standards under Ontario Regulation 153/04 for the intended land use.

Why is a Record of Site Condition needed?

An RSC is necessary in various situations, including:

  • Change in Land Use: When converting a property from a less sensitive land use (e.g., community, commercial, or industrial) to a more sensitive land use (e.g., residential, parkland, or institutional).
  • Due Diligence: To demonstrate that appropriate environmental assessments and necessary remediation or risk management measure have been completed during a property transaction or redevelopment.
  • Regulatory Compliance: To fulfill MECP and/or municipal government requirements for land use changes, building permits, or planning approvals.
  • Protection: An RSC provides legal protection from environmental liability from any existing contamination for property owners and stakeholders under specific conditions.
